이라크 전력부 입찰참여 시 에이전트 이용이 바람직

- 입찰기한 촉박 및 서류구입 선별 등 에이전트 역할 필요 -

□ 정보 내용

 

 ㅇ 최근 들어 이라크 전력부 입찰 참여에 대한 우리 업체의 문의가 내도해 참가방법과 조건에 대해 다음과 같이 안내하니 참고 바람. 우선 서류는 전력부 Head Office/Commercial Department (Baghdad Jumhouriya St. Bld.166, P.O.Box 1058, Postal code 12-112, email; geep_micomdep@yahoo.com)에서 구입 가능하며, 서류 가격은 프로젝트에 따라 10달러에서 2500달러로 천차만별이나 외국기업이 참여할 수 있는 입찰서류는 최소 200달러 이상임. 참가서류 구입 및 제출은 현지 에이전트는 물론 외국기업이 직접 할 수도 있음.

 

 ㅇ 참가 시 서류는 Technical Offer, Commercial Offer, The company foundation certificate 등이 각각 들어 있는 3개 봉투(우표 붙인 자기앞 반신용 봉투 ; stamped envelop)를 기한 내 제출해야 하며, 각 봉투 표면에는 회사명, 입찰번호, 제품명이 명기돼야 함.

 

 ㅇ 참가 시 일반적인 오퍼 조건은 다음과 같으며, 마감기한을 어기거나 하기 조건을 충족시키지 못한 서류는 자동 입찰에서 제외됨.   

 

  1) Prices to be on CIF (buyer stores).

 

  2) Payment conditions to be: either by irrevocable L/C payable as follows:

   - 20% down payment against B/G approved from trade bank of Iraq(TBI).

   - 15% of each shipment to be paid upon arrival of goods at the Iraqi borders and presentation shipping documents and commercial invoice.

   - 65% to be paid after arrival of goods completely to site in compliance with our specifications and requirements and an issuance of certificate by our side. Or payment 100% by Iraqi dinar after arrival of goods completely to site in compliance with our specifications and requirements and an issuance of certificate by our side.

 

  3) A commercial and technical offers are to be submitted in two separate sealed and stamped envelopes, the technical offer should consists the entire required document except the price.

 

  4) Submitted with offer:

   A) Certified check or a bid bond B/G amounting to 1.5% from the total amount of the offer via Iraqi banks to be submitted with offer, otherwise, the offer will not be considered.

   B) Certificate of registration and foundation of the company to be submitted with the offer.

   C) Tender purchasing receipt to be attached to the technical offer.

 

  5) Present a performance bond(approved by TBI) represented 5% of the total amount of contract with in 15 days started with the contract issuing date.

 

  6) Warranty period: to be fixed clearly (if requested) mentioned and covered by the performance bond.

 

  7) Penalties(Second party must adhere to supply materials within the time specified if second party fail to deliver the goods during the contracted time, (total amount / ¼ delivery period x 10%) will be deducted per week of delay and penalties must not exceed 10% from the total amount of the contract).

 

  8) Inspection to be performed by a recognized international inspecting Co. accepted by MO bidders expense, and an inspection certificate to be submitted.

 

  9) The directorate is not bound to accept the lowest offer or any other offer.

 

  10) Offer validity: 3 months from the closing date of the tender.

 

  11) Origin of goods to be clearly indicate.

 

  12) Materials subject to increasing or decreasing according to actual necessity

 

  13) The Iraqi security situation is not to be considered as force majeure.

 

  14) The tender is subject stamp duty which represents (0.2) from the amount and taxes.

 

  15) Transportation of goods from any port (in any country) to final destination in Iraqi should be effected through the Iraqi state co., for land transportation or any transporting contracted with Iraqi state co. land transportation.

 

  16) Unloading period at site will be max of 5 days after the arrival of goods.

 

  17) The contract to be concluded should be written in English and Arabic languages.

 

  18) Any disputes or differences arising out of the execution of the contract shall be solved amicably, in the event of non- agreement the subject shall be referred to the Iraqi court the Iraqi laws and regulations shall be applied.

 

□ 정보분석 및 평가

 

 ㅇ 일반적으로 이라크 정부 부처 입찰 참여 시 외국업체가 직접 참가할 수도 있으나 입찰기한 촉박, 입찰서류 구입 등 현지 실정을 감안할 때 에이전트를 통해 참가하는 것이 바람직한바, 입찰에 관심있는 업체는 우선으로 현지 에이전트 선정이 선행돼야 함.

  - 이라크는 전쟁 이후 비즈니스 체계 붕괴로 현재 우후죽순식으로 신규기업이 생겨나서 신뢰성 있는 현지 기업인 발굴이 쉽지 않은 실정이기 때문에 바그다드 KBC와 긴밀한 협력이 필수적임.

 

 ㅇ 이는 대부분의 입찰일이 입찰발표 후 2~3주 정도로 매우 촉박하며, 입찰서류 역시 비교적 고가이기 때문에 현지 에이전트를 통해 구입여부를 선별할 필요가 있음.

 

 ㅇ 변압기 등 전기제품은 KEMA 인증이 있어야 함.
