미국 국토안보부와 세관은 최근 미국 태양광발전(PV) 패널을 생산하는 Solyndra Inc.사가 외국산 부품을 사용해 미국 내에서 생산한 자사제품의 원산지가 미국산인지에 대한 판결을 요청한 것에 대해 미국산으로 판정함. 미국 정부는 현재 정부조달 시 바이아메리칸 조항에 따라 미국산 제품만 구입하도록 돼 있어 한국 업체들이 미국 내 생산업체들에 원료와 부품을 공급함으로써 미국 정부 조달시장에 진출할 가능성이 있는 것으로 판단돼 이 사례를 요약·정리함.

  - 2010년 2월 17일, 미국 국토안보부와 세관에 미국산으로 인정받을 수 있는지 판정 요청

  - 6개월간 이 요청에 대해서 조사와 판단과정을 거침.

  - 2010년 9월 29일, 이 회사의 제품은 미국산으로 판정

ㅇ Front End 프로세스 : 5단계  1) Bare glass tubes are cleaned using standard ultra-sonic bath and surfactant technology.  2) Quality assurance testing is conducted using precisely calibrated machinery.  3) Using Solyndra’s proprietary in-line vacuum systems and physical vapor deposition and evaporation techniques, several layers of different thin films of molybdenum, copper, indium, gallium, and selenium, are deposited on the glass tube.  4) The glass tubes are immersed into a precise chemical mixture, at a controlled temperature and Cadmium Sulfide is deposited onto the glass at a controlled thickness.  5) Using either lasers or mechanical scribes to define solar cells and interconnect them, the deposited films are precisely patterned to increase the solar collection efficiency of the glass tubes.   ㅇ Back End 프로세스 : 8단계  1) The processed glass tubes are encapsulated in a plastic middle tube and a glass outer tube, creating a Module.  2) Metal connectors are placed at each end of the Module to enable the Module to float in the completed PV System.  3) Through a complex process that involves melting glass and metal together, the ends of each Module are covered with a stainless steel cap, creating a hermetic seal.  4) After removing water and air from the Module, an optical coupling agent is used to fill the space between the inner and outer glass tubes and a plug is placed at the end of the Module to complete the sealing process.  5) The plug is laser welded in place, and the weld is inspected for defects.  6) Using a mass spectrometer based Helium leak detection system, each Module is checked for leaks.  7) The approved Modules are then subjected to artificial sunlight and tested to determine the level of electricity being produced.  8) Based on their performance, tubes are grouped in sets of 40 to make each solar panel. Forty (40) finished Modules are pressed into each panel frame.

 

□ 미국산에 대한 법적인 원산지 규정

 

 O 1979년 통상조약법 3조(Title III of the Trade Agreements Act of 1979)의 파트 177에 근거

  - 해당 연도에 국가에서 100% 자란 제품이거나 생산된 제품

  - 전체 또는 일부의 외국산 재료로 구성됐을 경우, 이 재료가 “상당히 변형돼” 새롭고 다른 제품이 된 경우, 새 제품은 명칭·특성·사용 면에서 분명히 별개여야 함.

 

□ Solyndra, Inc. 제품의 미국산 판정

 

 O 판정근거

  - 솔라 PV 시스템이 미국에 소재한 생산시설에서 생산됨.

  - 솔라 PV 패널에 대한 모든 R &D가 미국에서 이뤄짐.

  - 사용된 부품의 상당수가 미국산

  - 복잡하고 의미있는 조립과정이 확실하게 미국에서 이뤄짐.

  - 유리튜브에 엷은 필름을 여러 겹 입힌 것이 새롭고 다르며, 전문화된 특성과 사용이 가능하도록 모듈로 변형됨.

 

 O 따라서 수입된 부품들은 상당히 변형됐으므로 미국산으로 인증

  - 최근 아프간 주둔 미군의 유류 수송대 피격으로 향후 솔라에너지 시스템 설치 증가 전망, 휴대용 태양광패널, 태양광 발전용 텐트커버, 컴퓨터/통신장비용 태양광 충전기 사용 착수

 

 O 미 정부 조달시장 진출 위해서 미국내 솔라패널 생산업체에 부품과 원료 판매하는 방법이 우선

  - 미국 정부 조달 시 미국산만 구입할 수 있는 바이아메리칸 조항에 저촉받지 않기 위해 외국산 부품을 사용하는 미국 업체들이 이와 같은 판결 요청을 하는 경우가 증가할 전망
