1. Distribution Model in Brazil

 

□ There is a maximum of 3 levels for the distribution system: an International Producer must deal with the Representative or Importer, in certain cases directly to distributor, though no Final Consumer has chance to purchase skipping the whole procedure. On the other hand, products manufactured by a Brazilian Producer can be directly distributed to Final Consumer, and to the Distributor. The system is simplified as the followings:

 

 ○ International Producer → (Representative/Importer →) Distributor → Final Consumer

 

 ○ Brazilian Producer → (Distributor →) Final Consumer

 

 

2. Export & Import Trend

 

 ○ The import of Hand Dryer was increased by a remarkable figure, from $268,810 in 2010, to $525,664 in 2012, which is a 178% upsurge.

3. Certification (INMETRO)

 

□ The National Institute of Metrology, Standardization and Industrial Quality – INMETRO

 

 ○ A federal agency under the Ministry of Development, Industry and Foreign Trade, which acts as Executive Secretariat of the National Council of Metrology, Standardization and Industrial Quality(Conmetro), inter collegiate, which is the regulatory authority of the National System of Metrology, Standardization and Industrial Quality(Sinmetro).

 

 ○ Aiming to integrate a systemic framework articulated the Sinmetro the Conmetro and INMETRO were created by Law 5,966, of December 11, 1973, leaving the latter to replace the then National Institute of Weights and Measures(INPM) and significantly expand its radius of action in the service of the Brazilian society.

□ 14/07/2011 - Regulatory compulsory for 97 households appliances

 

 ○ The Brazilian market will be more energized with the new wave of home appliances that bear the stamp of conformity identification INMETRO. Starting this month, a group of 97 families and similar appliances, domestic and imported, must be certified in accordance with compulsory regulation of the Institute.

 

 ○ To answer questions of trade, industry and importers INMETRO published a Guide to the General Guidelines on INMETRO / MDIC 371/2009.

 

 ○ "We hold today, in Brazil, 198,000 products on the market with the seal of conformity assessment INMETRO, involving 6,980 enterprises," said Alfredo Lobo, Director of Quality INMETRO.

 

 ○ Ordinance 371 is based on a standard of the International Electrotechnical Commission(IEC) for household and similar and aims to increase the safety of the user of these devices. To Lourival Kiçula, president of Electrons, mandatory certification will encourage more competition among manufacturers adequate domestic and imported. "With the compulsory certification, at least the requirements of safety standards will be applied to all products, making everyone play the same game. This will make the competition fairer," he said.

 ○ OBS: It is important to understand that to certify a product implicates in having a Brazilian representative, since INMETRO and ABNT only provide their services to companies that have Brazilian representatives. The company needs to have a CNPJ(national register of legal entities).

□ Warranty varies from 6 months to 10 years, depending on the specific case of the problem. All companies provide after service.

 

□ One of the main reasons INMETRO requests a representative to give their certification is the after service. An imported product must provide assistance to the clients if needed.

 

□ In Brazil, companies need to follow certain rules, and these rules are determined by: The Brazilian Code of Consumer Protection(CDC - Código de Defesa do Consumidor)

 

 ○ The Brazilian Code of Consumer Protection(CDC) is the Brazilian legal system, a set of rules aimed at protecting consumer rights, as well as disciplinary relationships and responsibilities between supplier(product manufacturer or service provider) with the end consumer, establishing standards of conduct, terms and penalties.
