미국 정부조달시장 진출, 법 공부부터 하자!

- Buy American Act: 예외가 인정되지 않는 한 100% 국내산 선호 -

- Berry Amendment: 미 국방성 식량, 의류, 특수금속 등 구매 시 100% 국내산 의무 -

 

 

 

□ Buy American Act(미국산 우선 구매법, BAA)

 

 ○ 미국의 국내산 우대법령 중 가장 중요한 법

  - BAA는 미국 연방정부 조달 관련 국내산을 우대함으로써 국내 근로자들을 보호하기 위해 1933년 제정된 법

  - 이 법은 특정 예외항목이 적용되지 않는 한·미 연방정부가 공용물품을 구매할 시 국내산을 구매해야 한다고 규정

  - 아울러 미국산 선별기준을 계약자의 국적이 아니라 채취, 생산 또는 제조 장소로 규정

  - 제정된 이래 실질적인 개정은 4차례 있었으며, 특정분야의 조달을 고려할 땐 여타 제정법(예: 하기 Berry Amendment) 및 국제협정을 함께 살펴봐야 함.

  - 이 법은 모든 연방정부 조달에 적용되지만 보급품 계약과 건설 계약에 대한 조항을 따로 두고 있음.

  - 상품의 국내산 여부 판별 테스트는 이 두 종류의 조달에 모두 동일하지만, 테스트가 적용되는 제조 또는 건설과정의 단계가 각각 다름.

  - 원산지 테스트가 정부에 납품되는 보급품(완제품)에 적용되는 데 반해 건설계약에서는 계약자 및 하청 계약자가 건물 등을 건설, 개조, 보수하는 데 있어 사용한 물품, 재료 및 보급품(건설재료)에 테스트를 적용

  - 아울러 이 법은 제조 및 비제조된 물품의 차이를 구분함. 비제조된 물건은 미국 내에서 채취·생산되면 국내 완제품 또는 건설재료로 여겨지고, 제조된 물품은 미국 내에서 제조되고 부품이 실질적으로 모두(※substantially all) 미국 내에서 채취·생산 또는 제조되면 국내산으로 여김.

   ※ 'substantially all'이란 외국산 부품의 비용이 모든 부품비용의 50%를 초과하지 않는 것임.

 

 ○ 5가지 주요 예외사항

 

 1) 공익에 부합하지 않음: BAA의 적용이 공익에 부합하지 않는다는 판단이 내려지면 해당 정부기관의 수장은 이 법의 적용을 면제할 수 있는바, 이는 주로 국방성에 의해 국가 안보를 위한 예외처럼 이용되지만 비방위 목적으로도 사용

 

 2) 비합리적 비용: 정부기관의 수장이 가장 싼 국내제품의 가격이 비합리적이라고 판단하면 외국산 제품의 사용을 허락할 수 있음.

  - 가격의 비합리 여부 판별과정에서는 가격 차별 제도가 적용되는바, 일반적으로 대부분의 연방정부 계약에는 외국산에 6%를 할증하며 소기업 또는 근로 공급 과잉지역에는 12%를 적용, 국방성 조달 시엔 50% 할증 적용

 

 3) 국외 사용: 국외 사용을 위해 구매된 물품은 이 법의 적용으로부터 면제

 

 4) 불충분 공급: 국내에서 상업적으로 충분한 양과 만족할 만한 질의 상품이 합리적으로 유효할 만큼 생산 또는 제조되지 않을 시

  ※ 자세한 불충분 공급 물품 리스트는 아래 부록 1) 참조. 참고로, 정부기관은 수시로 불충분 공급 요건을 만족한다고 판단되는 물품을 FAR(Federal Acquisition Regulation) 위원회에 제안할 수 있으며, FAR 위원회는 5년에 한 번씩 물품 리스트를 업데이트함.

 

 5) Micro Purchase Threshold: BAA는 3000달러 이하에는 적용되지 않음.

 

□ The Berry Amendment

 

 ○ 미 국방성의 특정물품 구매 시 100% 미국산을 의무화

  - 원래 2차 세계대전 동안 미군들이 100% 미국 내 생산된 군복을 입고 식품을 먹게 하려고 제정된 법

  - 도구 및 특수금속 관련 부분은 후에 추가됐으며, 1933년에 제정된 BAA 상의 국방성 관련 조달품목의 예외조항들을 무효화했음.

 

□ Buy American Act vs. Berry Amendment

- 1933년 제정 - 미 연방정부 모든 부처의 조달 관장 - 국내적으로 생산, 제조, 또는 재배된 물품을 선호함으로써 국내 근로자를 보호하려는 목적 - 미국 내에서 이행되는 연방정부 계약에만 적용 - 외국 부품들의 비용이 전체 부품비용의 50% 이상이 되어서는 안 됨.	- 세계 제2차 대전 전날 제정 - 미 국방성 조달만 관장 - 특히 식량, 의류, 특수금속 부분에 한해 BAA의 예외조항들을 무효화함. - 국방 계약에만 해당하며 미국 내·외에서 진행되는 계약에 모두 적용 - 부품이 100% 국내산이어야 함.

 

□ 시사점

 

 ○ 미 연방정부 조달시장 관련 법에는 상기 두 가지 주요 법령을 제외하고도 여러 복잡한 법령이 존재하는바, 우리 기업은 진출하려는 분야 관련 법령을 사전에 숙지할 필요가 있음.

 

 ○ 미 연방정부 조달 관련 법전은 FAR(Federal Acquisition Regulation)이며, 그 외 각 정부기관은 추가 법전을 둠. 대표적으로 미 국방성은 DFARS(Defense Federal Acquisition Regulation Supplement)를 둠.
